    This documentary is increasingly popular as a tool for portraying the consequential damages that a plaintiff has sustained because of an incident that caused an injury. The jury will see and understand how the plaintiff's life has been changed. It is an effective method of presentation that fairly, honestly, objectively and accurately portrays a plaintiff's altered lifestyle. It will let the injury and its effect speak for itself. The jury can intelligently place a value on the case because they understand the injury and its impact. And, trial counsels will have the enhanced ability to comment on the disability during final argument.

    Around 15 minutes long, the documentary will demonstrate, for example, the profound damages of a brain injury or any other physical handicaps with the dependence. It is difficult for a member of the jury to imagine what it is like to put on a prosthesis every morning, where there had been a leg; to imagine an individual taking off a sock in 10 minutes; to feel the emotional and psychological distress of the spouse, children or parents; or, to understand why someone can no longer perform her/his job. It is not difficult to believe when captured on video.

    Similar but different from the “Mediation documentary aka Settlement documentary”, an “Activities of Daily Living, aka ADL” cannot deliberately play on the emotions of the jury: there is no background music soundtrack, scripted narration, computer animation, professional voice over, blood and guts, excessive pain and suffering, etc. Our pre-production meetings will determine what you need to prove.
